
Since 2021, the Government of Ontario has passed several iterations of its Working for Workers legislation, each of which has amended important employment-related statutes like the Employment Standards Act (ESA) and the Occupational Health and Safety Act.
Notably, the Working for Workers Four Act, 2024 and the Working for Workers Five Act, 2024 both created new legal requirements under the ESA in respect of the recruitment process. With these new requirements set to come into effect on January 1, 2026, it’s crucial that employers act proactively in the coming weeks and months to ensure that they properly understand the scope of their new statutory obligations and adequately prepare for compliance.
